Intellectual Property Policy

This Intellectual Property Policy ("IP Policy") describes the ownership, protection, and infringement procedures for intellectual property on the SYNC-Gift platform. We respect intellectual property rights and expect our users to do the same.

1. SYNC-Gift Intellectual Property

The following are the exclusive intellectual property of SYNC-Gift Inc. and are protected under Canadian, US, and international intellectual property law:

No licence to use SYNC-Gift's intellectual property is granted except as expressly set out in our Terms of Use. Unauthorised use may constitute trademark infringement, copyright infringement, or unfair competition under applicable law.

2. User Content and Licence

You retain ownership of original content (photos, videos, messages) that you upload to SYNC-Gift. By uploading content, you grant SYNC-Gift Inc. a worldwide, non-exclusive, royalty-free, sublicensable licence to use, reproduce, display, and distribute your content solely for the purpose of providing and improving the Services.

3. Copyright Infringement — DMCA Policy

SYNC-Gift respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA) (17 U.S.C. § 512) and equivalent Canadian copyright law (Copyright Modernization Act).

3.1 Reporting Infringement (DMCA Takedown Notice)

If you believe your copyrighted work has been copied and is accessible on SYNC-Gift in a way that constitutes infringement, please submit a written notice to our Designated Agent including:

3.2 Counter-Notice Procedure

If you believe content was removed in error, you may submit a counter-notice to legal@syncgift.com including your contact information, identification of the removed content, a statement under penalty of perjury that you have a good faith belief the removal was a mistake, and your consent to the jurisdiction of federal district court for your district. Upon receipt of a valid counter-notice, we may restore the content after 10–14 business days unless the original complainant seeks a court order.

3.3 Repeat Infringer Policy

SYNC-Gift maintains a policy of terminating the accounts of users who are repeat copyright infringers, in appropriate circumstances.

4. Trademark Infringement

Unauthorised use of SYNC-Gift's trademarks, trade names, logos, or trade dress in connection with goods or services that are likely to cause confusion, or in a way that disparages SYNC-Gift, is prohibited. To report trademark infringement: legal@syncgift.com.

5. Patent Policy

SYNC-Gift has filed or intends to file patent applications covering aspects of its platform, hardware (SYNC Status Ring), and related technology. Unauthorised reproduction, manufacture, sale, or use of patented technology is prohibited. We grant no patent licences except as expressly stated in writing.

SYNC-Gift uses open-source software components that are licensed under their respective licences (MIT, Apache 2.0, etc.). We comply with all open-source licence obligations. A list of open-source dependencies is available upon written request.
